Licence Terms

In three sentences

Alunima is given to you to use, not to redistribute. Your films, your drawings and your comments are yours, and they stay on your machine. The software is bought once: no subscription, no end date, and nothing to renew.

The rest of this document spells those three points out. It is written to be read.

1. Who grants you this licence

Alunima is published by Frédéric Multier, sole trader, and is licensed to you under these terms. By installing or using the software, you accept them.

2. What you may do

2.1 What your licence covers

Your licence covers Alunima version 1 and every update to it — 1.1, 1.2, and so on to the last release of the 1 series. Those updates are included at no extra cost, for as long as the series is developed.

It has no end date. There is no subscription, and nothing switches off for lack of renewal — there is nothing to renew.

You may use Alunima for your work, professionally and on commercial productions. You create, annotate, export and distribute freely what you make with it — your videos, your exports, your animatics. Alunima claims no rights over your work.

2.2 One licence, one person, two machines

A licence is granted to one person, for one workstation.

That same person may install Alunima on a second machine of their own — a laptop, a computer at home — provided the two are not used at the same time.

What is not allowed is sharing one licence between several people, or running one licence on two workstations simultaneously.

You may move your seat: reinstall on a new machine, switch computers, reinstall after a failure. For that, each licence carries a number of activations deliberately higher than the number of machines allowed, so as to absorb changes of computer over the whole life of your licence; that number is given in the schedule. Those spare activations do not entitle you to extra machines: the entitlement stays at two, they are there to maintain your licence.

If your activations are used up, write to us and we will return one to you.

What "returning an activation" actually means. Alunima never disables a copy from a distance (§ 2.3). Returning an activation frees a slot for your new machine; it does not remotely disable the copy installed on the old one. We simply ask that you stop using it, and uninstall it if you no longer need it.

2.3 Activation

To open the purchased version, Alunima checks your key once, online, when you activate. That check registers a randomly generated identifier from your machine — not its name, not yours, and no data about you. It is the only thing your licence requires of the internet to get started: plan for it at install time.

After that, Alunima keeps the proof of purchase locally and re-checks at most once a day, silently. That check asks nothing of you and never interrupts you.

If it does not get through — no network, server down, a studio cut off from the world — nothing at all happens. Your licence keeps working, indefinitely. No countdown, no message, no limit on how long you may stay offline: silence is never read against you.

It can only have an effect if the server explicitly answers that the key is no longer valid — after a refund, for instance, or if the machine has been released. Alunima then tells you so, and what to do about it.

Releasing a machine yourself. Before you leave a computer, open About and choose Release this machine: the seat is freed at once and can be used elsewhere.

2.4 Backup copies

You may keep a copy of the installer and of the versions you have downloaded, for your own archiving and reinstallation. Those copies remain subject to these terms and may not be given to anyone else.

2.5 Multi-seat licences

A multi-seat licence is granted to a named organisation — studio, school, association — for the number of seats purchased. It may be shared among the people working there and reassigned when someone leaves.

Licences are counted per seat, not per project folder. In a team, activating one seat does not activate anyone else's: every person working in Alunima uses a seat.

It may not be resold, lent or transferred to another organisation. It does follow the business if that business is transferred, acquired or merged: tell us, and the licence continues in the name of the new organisation.

3. What you may not do

• Redistribute the software — resell it, put it online, share it outside the setting in which you received it;
• resell, lend or publish your licence key, or give it to anyone not covered by your licence;
• modify, decompile or disassemble it, except within the limits the law grants you notwithstanding any clause to the contrary;
• remove the authorship notices, or disable and circumvent the licence mechanism, the trial-period marker, or the limitations of the trial version;
• use it for any unlawful purpose.

4. The trial period

Until your seat is activated, Alunima runs for thirty days, unrestricted and without asking you for anything.

To count those thirty days, Alunima writes a date marker. That marker contains nothing but a date and a randomly generated identifier: not your name, not your machine's name, nothing you produce. It is written next to your data, never inside it, and it is not part of the files your team exchanges: it is never merged, synchronised or read by the team features. None of it leaves your machines.

Two consequences, which we would rather state up front:

• if you start working in a folder where a trial has already begun, that earlier date is the one that counts for you too. The trial covers evaluating the software on a given piece of work, not each person who passes through;
• an activated licence always wins over this marker. As soon as your seat is activated it is no longer consulted. A trial that has started, even an expired one, can therefore never get in the way of a purchased seat — including on the very folder you evaluated with.

When the trial ends, Alunima does not shut you out. It becomes read-only and export is disabled: you can still open your projects and review your shots and annotations. Nothing is deleted, nothing is locked, and your work is never held hostage.

Buying means carrying on where you are. You enter your key and the folder you were working in resumes exactly as it was, with its versions and annotations: the trial never touched your data.

5. Purchase, payment and withdrawal

Licences are sold by Lemon Squeezy, acting as merchant of record: they take payment, issue the invoice and collect the VAT applicable in your country.

Right of withdrawal. As this is digital content supplied immediately, the law lets you waive your fourteen-day right of withdrawal, and you are asked to do so expressly at checkout.

That waiver only takes effect when you activate your licence — that is, when performance actually begins. Until you activate, your fourteen days remain intact: receiving a key does not commit you, using it does.

Regardless of that, if Alunima does not work for you, write to us and we will refund you. A thirty-day trial exists precisely so that nobody buys blind.

6. What the software does with your data

This is the heart of Alunima, and it is a commitment.

Nothing leaves your machine. No account, no server, nothing sent. Your films, your drawings and your comments live in a folder you chose. Unplug the network: Alunima works exactly the same. No usage data, no statistics, no trackers.

In a team, sharing goes through a folder you designate — a shared drive, or your own synchronisation service. Alunima adds no intermediary: what is there passes through no service of the publisher's.

The three exceptions, and exactly what they send

It would be dishonest to write "nothing leaves your machine" without naming the moments when something does. Here they are, without exception.

Activation and its re-check (§ 2.3). This is the only one that is not optional. It sends your licence key and a randomly generated identifier, and nothing else: not your name, not your machine's, not anything from your work.

The update check. Alunima reads a public file giving the latest available version number. Nothing is sent, and nothing is downloaded or installed automatically: you are simply told that a version exists.

Discord notifications — off by default, and at your initiative. If you turn them on for a project, writing "@someone" in a comment sends a message to the Discord channel you designated. That message contains the author's name, the names of the people mentioned and the shot reference — sequence, shot, version. Never the text of the comment. This feature is an explicit choice, project by project, and can be switched off at any time.

You can work without either of them: offline, Alunima works.

7. The data involved in your purchase

§ 6 describes what the software does. Buying, however, necessarily involves some information about you. Here it is.

Licences are sold by Lemon Squeezy (§ 5), who collect what a sale requires — name, billing address, email address, payment details — and issue your invoice. That information is handled by them, under their own terms; we never have access to your payment details.

On our side, we keep what is needed to honour your licence: your email address, your key, the date of purchase, and the activations attached to that key (each identified by a randomly generated identifier, never by your machine's name). We use it to deliver your updates, answer your support requests and return an activation when you change machines — and for nothing else. No resale, no sharing with third parties, no profiling, no marketing without your consent.

For how long. We keep this information for as long as your licence is of use — it is perpetual, and we must be able to deliver an update or return an activation to you years after your purchase. It is then erased three years after our last exchange. The accounting records of your purchase are kept by Lemon Squeezy for as long as the law requires of them.

The data controller is Frédéric Multier. You have the right to access, correct, erase and object, exercisable at the contact address at the end of this document. Erasing the data attached to your key ends our ability to return an activation or deliver updates to you; the software you have installed keeps working.

8. What is guaranteed, and what is not

Alunima is sold software, and it must do what its documentation and its website say it does. If it does not, write to us: we fix it, or we refund you.

We do not, however, guarantee:

• that it meets a particular need of your own that we have not advertised;
• that it runs without any defect, or on hardware or software configurations we have not tested;
• that it stays compatible with versions of macOS or Windows released after the end of the 1 series (§ 10).

Keep your own backups. Alunima keeps dated copies of its own project files, but that is no substitute for a backup of your own. Your original media in particular remain your responsibility.

Two different things, not to be confused. What comes above is what we undertake to do: fix it, or refund you. What follows is something else — the ceiling on what could be claimed from us if a disagreement went as far as a court. The first is a promise, the second a cap: it is not a sum we undertake to pay.

The extent of our liability. To the extent permitted by law, our total liability, on any basis whatsoever, cannot exceed the price you actually paid for the licence concerned — the price of the pack if you bought several seats. Within the same limits, we are not liable for indirect damages — loss of business, loss of revenue, business interruption, loss of data or files.

For how long. This limit applies for as long as our liability can be pursued. We do not shorten the time the law gives you to act: neither the statutory guarantee period nor the limitation period.

Why these limits exist. Alunima's price takes account of these warranty and liability limits: they are part of the economic balance of the contract. Software sold once, at this price, could not answer without a ceiling for the indirect consequences of its use on a production.

Depending on whether or not you buy for your professional activity. The limits above apply in full to a professional buyer. To a consumer, they apply only to the extent that the law applicable to them allows.

What the law guarantees you regardless. If you are a consumer in France or the European Union, the statutory guarantee of conformity for digital content and the guarantee against hidden defects apply, and no clause can deprive you of them. The paragraph above does not set them aside. Nor does it apply in cases of gross negligence or wilful misconduct on our part. Finally, some countries do not allow the limitations of liability written above: if yours is one of them, they do not apply to you.

9. Support

Support is provided by email, to the person who bought the licence — or, for a multi-seat licence, to the contact the organisation has designated.

It covers installing, activating and using Alunima, for the whole life of the 1 series, at no extra cost.

Alunima is published by one person. Support is given in earnest, but with no guaranteed response time, no cover outside working hours and no on-call commitment: it is not a continuously available service, and we do not promise to resolve every difficulty. If your organisation needs response-time commitments, write to us before buying rather than after.

What support covers. It covers Alunima. It does not cover training in animation, editing or running a production; nor your hardware, your network, your shared drives or your synchronisation services; nor files produced by other software; nor recovering data lost by anything other than a defect in Alunima. On those subjects we answer when we can, without that constituting a commitment.

We do not support an earlier version where an update within the 1 series fixes the problem you have run into: the first answer will be to invite you to install it.

10. Term, later versions and ending

This licence is granted with no time limit, for as long as you abide by its terms.

Later major versions are paid. When Alunima 2 is released it will be a separate product, sold separately. Holders of a version 1 licence will be entitled to it at a reduced price. We make no commitment as to timing: version 2 will be released if and when it is ready.

If you bought your licence within the six months before version 2 is released, you get version 2 at no charge. This rule exists so that buying on the eve of a new version is never a bad deal.

Your version 1 does not stop. It keeps working with no time limit and no online check, including after version 2 is released.

You may stay on whichever version you choose. Nothing obliges you to install an update within the 1 series. Be aware only that support covers the current version (§ 9), and that a defect already fixed elsewhere will not be fixed a second time for a version you have chosen to keep.

What does end, when version 2 is released, is updates and support for the 1 series — including compatibility updates for future operating systems. In other words: the software you bought stays yours and keeps running, but we do not guarantee it will still open on a macOS or Windows released years later.

Ending the licence. It ends if you breach its terms — redistribution, key sharing, or circumventing the licence mechanism. In that case you are asked to stop using Alunima and uninstall it from your machines. Your data remains, as always, intact and readable in your project folder: it does not belong to us, and nothing above deprives you of it.

11. Third-party components

Alunima builds on free software. Here is the list, with its licences. None of them imposes any constraint on Alunima itself or on what you produce with it.

The full text of these licences is supplied with the application. Their presence gives you no additional rights over Alunima itself.

Playback of certain video formats relies on technologies that may be patented in some countries. That question belongs to the underlying media engine, common to every piece of software that uses it.

12. Your feedback and suggestions

Alunima improves through what you tell us about it, and your remarks are welcome.

If you report a defect or suggest an idea, you allow us to take it into account and implement it in the software, without that creating any obligation, exclusivity or payment on your side or ours. We claim no rights over whatever else you do with that same idea: it remains as much yours as before.

We do not publish your name or the content of your exchanges with us without your agreement.

13. The version of these terms

These terms carry a date. The ones that apply to you are those in force on the day you bought your licence, and they do not change afterwards: a later rewrite applies only to licences sold after it.

The authoritative copy is the one shipped with the version you bought, in docs/license.pdf. Keep it with your invoice.

14. Governing law

These terms are governed by French law. In the event of a dispute, an amicable solution will be sought before any legal action.

Jurisdiction. Failing agreement, and between professionals only, the courts for the publisher's registered address have sole jurisdiction. A consumer buyer keeps the right to bring proceedings before the court of their own place of residence — no clause can take that away.

If you are a consumer resident in another country, this choice does not deprive you of any mandatory protection granted to you by the law of your country of residence.

French is the language of the contract and the French version prevails. The English translation is provided for your convenience.

In a dispute with a consumer, that consumer may use a consumer mediator free of charge, or the European online dispute resolution platform.

15. Miscellaneous

If one clause falls, the others stand. Should any of these clauses be held void or unenforceable, it will be treated as unwritten and the rest of the document will continue to apply.

Not enforcing a right does not waive it. Not invoking a clause at one point does not prevent us from invoking it later.

This document is complete. It constitutes the entire agreement between you and us concerning the licence of Alunima, and replaces earlier exchanges on the same subject — including the terms of the beta period.

Schedule — the offer

This schedule describes what each option contains. It forms part of the contract and may change: the terms that apply to your licence are those of the schedule in force on the day you bought it (§ 13). Current prices are on alunima.app; the price you paid is on your invoice.

Every option includes: the complete 1.x series and its updates; macOS and Windows, signed; the email support of § 9; offline operation with no time limit after activation (§ 2.3); the upgrade to Alunima 2 at a reduced price, free if the purchase falls within the six months before its release.

Educational licence (schools). Granted to an institution for its teaching and its students' coursework. It does not cover the institution's commercial productions or work carried out for third parties; those need an ordinary licence.

Fixed-term licences (schools, students, beta testers). Some licences are granted for a fixed term — one year for schools and students — given at activation and shown at all times in About. They do not renew automatically. On its date the licence ends: Alunima becomes read-only, and your work stays intact, readable, and exportable again as soon as a licence is active.

Renewal is asked for. Write to us before the date. We are under no obligation to renew, and the terms of a renewal — free or priced, and for how long — are those in force on that day. A renewal granted once is no commitment for the next.

Who they are for. A student licence is granted to a person enrolled at an educational institution, for their studies and their learning; it does not cover paid work or commercial production. An educational licence is granted to an institution, for its teaching. Proof may be asked for, both when granting and when renewing.

If you are no longer a student, your licence ends on its date. Write to us: we may be able to offer you a transition price towards an ordinary licence.

Trial version. Thirty days, all features, no credit card. Afterwards Alunima becomes read-only and export is disabled (§ 4).

Complimentary licences. We may issue licences at no charge — beta testers, partner schools. They fall under exactly the same terms as purchased licences.
